A woman has pleaded guilty to murder after shooting and killing a rapist who was strangling her brother.
Woman receives prison sentence for killing her rapist: Brittany Smith, 32 and from Alabama, was accused of shooting Todd Smith, who is no relation, in January 2018. An argument between Mr Smith and Ms Smith’s brother, Chris McCallie, broke out. After he discovered hours later of the vicious attack on his sister and called at her house where Todd, an acquaintance of Ms Smith, was found to still be there.
They confronted each other and Todd got McCallie in a headlock. It was stated that Todd had been high on drink and drugs at the time. Brittany grabbed a gun and shouted at Todd to stop and, when he didn’t, she shot him.
She then called emergency services to say someone had been shot and also told them that he had tried to kill her. Being indicted on murder charges by a jury in March 2018, she had many defendants that tried to get the charges dropped by using the Stand Your Ground self defence laws.
During the hearing, at Jackson County Courthouse in Scottsboro, Alabama, Jeanine Suermann, a sexual assault nurse who had examined Brittany after the attack, said that she had been strangled, bitten and assaulted. Presiding Judge Jenifer Holt denied the application, saying that Brittany had no need to use a lethal weapon to end the altercation and that her brother had also bought a weapon to the house and started the argument with Todd.
A month before her trial was due to start Brittany pleaded guilty on Friday to the murder charges and was sentenced by Holt to 20 years in prison, but will only serve 7 months of that term.
